This Damage Policy is an addendum to the Terms & Conditions found within the original contract provided by Worry Free Snowblowing Inc. (herein after referred to as the “Contractor”).
Damage Caused by Contractor
Due to the risks posed by our equipment to immoveable property, you accept that our drivers will stay no less than two (2) feet away from garage doors at all times.
The Contractor shall be responsible for and shall restore at its expense all damage to your property caused by the Contractor in the performance of this contract, apart from that damage reasonably foreseeable as a consequence of snow removal.
Reasonable Damage
You acknowledge that damage reasonably foreseeable as a consequence of snow removal includes, but is not limited to, scrapes, scratches, rust marks and other surface damage on driveway surfaces, curbs and other adjacent structures and surfaces resulting from contact with snow removal equipment.
The Contractor shall exercise due diligence in the performance of its work to avoid damage to property. To assist the Contractor in preventing damage it is your responsibility to keep the snow removal area (ie. driveway) free of all objects. In particular, the Contractor shall not be held responsible for damages, including but not limited to, the following:
Miscellaneous Damage
Garbage cans and Recycling bins
It is your responsibility to move garbage and recycling containers off the driveway on a snow day. The contractor will ‘work around’ any containers it encounters during the course of its work but will NOT remove them and will not clear away the snow underneath where they were sitting. If you have a damaged, broken or missing recycling bin or green bin, you can request a free replacement by calling 3-1-1 (city of Ottawa).
Basketball nets
Portable Nets: Please completely remove portable nets from driveway area or place no less then 4 feet from the edge of the driveway.
Immovable Nets: Prior to the commencement of the winter season, the net must either be: (1) elevated to at least 12 feet to allow for clearance by the tractor or (2) the backboard unscrewed and spun away from the driveway to be cleared.
Downspout extensions
These must be unscrewed and removed completely prior to the commencement of the winter season.
Patio furniture, plant pots, toys, hockey sticks, extension cords, Christmas tree lights etc.
All moveable property must either be removed completely or placed no less than 4 (four) feet from the edge of the driveway prior to each snowstorm.
Elevated water valve caps
Protruding water valve caps must be hammered down to the level of the surrounding asphalt. You may either do this yourself or may contact the City of Ottawa at 613-580-2400 and arrange to have a City employee perform the necessary maintenance prior to the commencement of the winter season.
Interlock Steps, Retaining Walls and Driveways
Interlock Steps & Retaining Walls
You are responsible for notifying the Contractor of any structures that protrude into the driveway and require protection from being hit by our equipment. Once notified, the Contractor shall install additional markers around any protruding structures to avoid causing damage. These protruding structures include, but are not limited to, interlocking steps, interlock or cement retaining walls, cement porches, brick retaining walls, garden beds, wooden retaining walls, elevated patio stones, wooden or interlock wheelchair ramps, etc. The Contractor will not be liable for damages caused to any immoveable objects hidden under snow and/or unidentified by protective markers.
Heaved, Chipped or Uneven Driveways
It is your responsibility to ensure an even driveway surface prior to the commencement of the winter season. The Contractor will not be responsible for replacing pieces of asphalt or interlock that get caught and torn out by snow blowing equipment dragged across uneven surfaces.
Interlock Repair
Should interlock be broken, chipped or damaged by the Contractor’s equipment, the Contractor will make every attempt to replace the affected areas with a matching stone. Should a matching stone not be available (e.g. discontinued), the Contractor will replace it with the best match available. In these instances, the Contractor will only replace the affected stones and will not replace the entire walkway or driveway surface.

Agreement
By making payment through the website (wfsnow.com), by PayPal, over the phone or by mail, you are effectively binding the contract and agreeing to the Terms and Conditions set forth within the contract and this Damage Policy.
